Woman to get new sentence for role in 2004 murder

One member of the group of five convicted of participating in the beating death of Scott Schader in September of 2004 will receive a new sentence on Friday.
In September, attorneys for Amanda Johnson, 23, successfully argued that the court relied upon inaccurate information regarding Johnson's psychological state when she was sentenced to six years in prison back in July of 2005.
In court papers, Johnson claimed she was taking very high dosages of an anti-psychotic drug when she underwent a psychological evaluation and also had trouble answering some of the questions because she didn't understand certain words.
As a result, those interpreting the test concluded that she was acting in a “defensive and disingenuous manner” and was “attempting to manipulate the criminal justice system.”
The defense also claimed a second test, performed when Johnson was taking a significantly lower dosage of her medication and understood what she was being asked, did not indicate defensiveness or a lack of honesty.
Johnson was one of five people convicted of participating in the Schader murder.
All five cases ended in plea agreements but the state indicated it would have argued at trial that Schader, 32, was driven to a secluded campsite on Ginty Lake by Johnson and his former girlfriend Nicole Waas. At the lake, the state claimed, Schader was attacked by David Lukasko, Charles Boos, and Todd Matson.
Johnson will be resentenced at 10 a.m. Friday.
