County considers outside legal help for zoning issues

The Oneida County Zoning Department has made two requests to the finance committee for authorization to hire outside attorneys.

In the first request, county planning and zoning director Karl Jennrich is asking for up to $20,000 to pay for an outside attorney to represent the county in its ongoing battle with the state over the definition of Ordinary High Water Mark (OHWM).

The second request is for up to $2,500 to get legal advice regarding a zoning controversy in the town of Minocqua. Jennrich told the finance committee Tuesday the department is in a dispute with a Minocqua developer regarding whether a lot the developer wants to use for condos was created before or after May 19, 1999. That date is significant, Jennrich said, because zoning regulations were amended at that time.

Jennrich also said the resolution of the situation is a concern to the department because it could impact other developments, including the latest attempt to turn the former Northernaire in Three Lakes into a condominium complex.

The new owners of the Northernaire are expected to meet with the zoning committee this summer, Jennrich said.

Jennrich said Oneida County Corporation Counsel Larry Heath advised the county secure an outside attorney on the Minocqua issue to avoid the appearance of impropriety on his part. The development in question is in the same neighborhood as Heath's property, Jennrich said.
